What is Form 12C?

Form 12C is the official Letter of Intimation submitted by Migrant Electors of Kashmir to cast their votes through postal ballots in Jammu & Kashmir Parliamentary and Assembly elections. Issued by the Election Commission of India (ECI), this form ensures that Kashmiri migrants living outside their native constituencies can exercise their voting rights without being physically present at a traditional polling station.

Purpose of Form 12C

While migrant voters who wish to vote in person at special polling stations (in Delhi, Jammu, or Udhampur) use Form M, those who prefer to vote via mail from anywhere in India must fill out Form 12C to receive a physical postal ballot paper.

Structure of the Form

The form is legally categorized under Rule 27-C of the Conduct of Elections Rules and is divided into two parts:

Part-I (Applicant Details):
The voter must provide their name, parent/spouse details, permanent Kashmiri address, current postal address, and specific details from the electoral roll (such as serial and part numbers). They must also include their migrant registration number or details about their government service/pension if applicable.

Part-II (Certificate of Attestation):
The particulars filled in Part-I must be verified and signed by an authorized official. This includes migrant camp officers-in-charge, heads of offices, Treasury Officers, Bank Managers, or any gazetted officer.

Notified voter means the voter who belongs to the class of persons notified by the Election Commission under clause (c) of section 70 of the J&K Representation of the people Act,1957. (A copy of the notification issued by the Election Commission of India is enclosed in this regard.)
