PRESS NOTE :
Sub: Byeelection from 315-Pharenda Assembly Constituency.
The Commission has announced the Schedule for byeelection from 315-Pharenda Assembly Constituency in Uttar Pradesh alongwith other byeelections vide Press Note No. ECPN23/2015 dated 10″ March, 2015.

The Honble High Court of Allahabad had stayed the current byeelection from 315 Pharenda AC. in Uttar Pradesh vide their Order passed on 20-03-15 in Writ.C No. 14270 of 2015 (filed by Sh. Bajrang Bahadur Singh). The Commission filed an SLP before the Honble Supreme Court (SLP (civil) No. 8850 of 2015- Election Commission of India vs. Bajrang Bahadur Singh & others) challenging the order passed by the High Court. On the said SLP, the Honble Supreme Court has today (23-03-15) stayed the order dated 20-03-15 of the Honble High Court of Allahabad.

In view of the above, the election process for the abovementioned byeelection will continue as per schedule. The Chief Electoral Officer of Uttar PradeshReturning Officer of the constituency and the District Election Officer have been informed of this development. They have been requested to inform the political parties also. Further, they have been requested to give wide publicity through media so that political parties and general public are informed that the election process is on.

PRESS NOTE :
Subject: Rescinding of announcement for byeelection to fill vacancy in the Legislative Assembly of Uttar Pradesh from 358-Rasara AC.

The Commission had announced the schedule of seven byeelections, including bye election from 358-Rasara AC in Uttar Pradesh, vide, its Press Note NoECIPN23/2015, dated 10th March, 2015.

Honble Supreme Court has stayed the above Press Note as far as 358-Rasara Assembly Constituency of the State of Uttar Pradesh is concerned, vide its Order dated 12.03.2015 passed in the SLPc) NO. 7608/2015.

In view of the said order of the Honble Supreme Court, the Commission hereby rescinds its announcement of byeelection from 358-Rasara AC in the Legislative Assembly of Uttar Pradesh made vide its Press Note NoECPN23/2015, dated 10″ March, 2015. Accordingly, no byeelection will be held from 358-Rasara Assembly Constituency for the time being.

The schedule of byeelections in respect of other six Assembly Constituencies as per aforesaid press note shall remain unchanged.

Subject : Schedule for byeelection to fill casual vacancies in State Legislative Assemblies of Maharashtra, Punjab, Uttar Pradesh, and Uttarakhand — Regarding.

2 Last date of making Nominations 24.03.2015 (Tuesday)
3 Scrutiny of Nominations 25.03.2015 (Wednesday)
4. Last date for withdrawal of Candidatures 27.03.2015 (Friday)
5 Date of Poll 11.04.2015 (Saturday)
6 Counting of Votes 15.04.2015 (Wednesday)
7 Date before which election shall 18.04.2015 (Saturday) be completed
Hours of Poll : 8 AM to 5 PM

ELECTORAL ROLL :
The electoral rolls of these Assembly Constituencies have been revised with reference to 01.01.2015 as the qualifying date and have been finally published on 21.01.2015 in Maharashtra, On 05.01.2015 in Punjab and Uttar Pradesh and on 15.01.2015 in Uttarakhand.

ELECTRONIC VOTING MACHINES (EVMs) :
The Commission has decided to use EVMs in the byeelection in all the polling stations. Adequate numbers of EVMs have been made available and all Steps have been taken to ensure that the polls are conducted smoothly with the help of these machines.

IDENTIFICATION OF VOTERS :
The Commission has decided that the voters identification shall be mandatory in the aforementioned bye-election at the time of poll. Photo Electoral Roll (PER) shall be the main document of identification of a voter. However, in order to ensure that no voter is deprived of hisher franchise, if hisher name figures in the Electoral Rolls, separate instructions will be issued to allow additional documents for identification of voters at the time of poll in the said byeelection.

MODEL CODE OF CONDUCT :
The Model Code of Conduct shall come into force with immediate effect in the districts) in which the whole or any part of the Assembly Constituency going for byeelection is included, subject to partial modification as issued vide Commissions instruction No. 437/INST2012/CCBE, dated 26″ April, 2012 (available on the Commissions website). The Model Code of Conduct shall be applicable to all candidates, political parties and the State Government concerned. The Model Code of Conduct shall also be applicable to the Union Government for the State concerned.
