PRESS NOTE :
Subject : Rescinding of announcement for bye election from 130Palghar (ST) Assembly Constituency to fill vacancy in the Legislative Assembly of Maharashtra – Regarding.
The Commission had announced byeelection from 130-Palghar (ST) Assembly Constituency to fill vacancy in the Legislative Assembly of Maharashtra vide its Press Note NoECIPN36/2015, dated 29″ May, 2015.
It has been brought to the Commissions notice that an Election Petition bearing No.EP21/2014 is pending in Bombay Bench of High Court of Bombay in respect of the 130-Palghar (ST) Assembly Constituency.
In view of the above, the Commission hereby rescinds its announcement of byeelection from 130-Palghar (ST) Assembly Constituency in the Legislative Assembly of Maharashtra made vide its Press Note No. ECPN36/2015, dated 29.” May, 2015. Accordingly, no byeelection will be held from 130-Palghar (ST) Assembly Constituency for the time being

A clear vacancy has arisen in the Legislative Assembly of Maharashtra from the 130-Palghar (ST) Assembly Constituency on 24th May, 2015 due to demise of Shri Krushna Arjun Ghoda, the sitting Member of Legislative Assembly. The

ELECTORAL ROLL :
The electoral rolls of the Assembly Constituency has been revised with reference to 01.01.2015 as the qualifying date and have been finally published on 21.01.2015
ELECTRONIC VOTING MACHINES (EVMs) :
The Commission has decided to use EVMs in the byeelection in all the polling stations. Adequate numbers of EVMs have been made available and all steps have been taken to ensure that the polls are conducted smoothly with the help of these machines.
IDENTIFICATION OF VOTERS :
The Commission has decided that the voters identification shall be mandatory in the aforementioned byeelections at the time of poll. Electoral Photo Identity Card (EPIC) shall be the main document of identification of a voter. However, in order to ensure that no voter is deprived of hisher franchise, if hisher name figures in the Electoral Rolls, separate instructions will be issued to allow additional documents for identification of voter at the time of poll in the said byeelection.
MODEL CODE OF CONDUCT :
The Model Code of Conduct shall come into force with immediate effect in the districts) in which the whole or any part of the Assembly Constituency going for byeelection is included, subject to partial modification as issued vide Commissions instruction No. 437/INST2012/CCBE, dated 26th April, 2012 (available on the Commissions website). The Model Code of Conduct shall be applicable to all candidates, political parties and the State Government concerned. The Model Code of Conduct shall also be applicable to the Union Government in respect of the above (Dhirendra Ojha) Director districts) of the State concerned.
